Practice Area: Criminal Law / Vehicular / Aggravated DUI

Date: June 14, 2023

Outcome: Reduced

Description: Maricopa County Superior Court: State v. Mr. H. M. (CR2022-145477-001). Mr. H. M. was charged with three counts of Aggravated DUI, Class 4 Felonies.  Mr. H. M. had one prior felony conviction.  The State initially offered a plea to Aggravated DUI and for Mr. H. M. to serve two and a half years in the Department of Corrections.  Attorneys at Castillo Law showed that one of the only reasons Mr. H. M. had the prior felony conviction was because Mr. H. M. owed fines but had otherwise complied with all terms of Mr. H. M.’s prior felony.  Upon submission of a deviation letter, Mr. H. M.’s plea offer was reduced from two and a half years of prison to only six months of prison.
