Hi my name is Cindy Castillo with Castillo Law. Today I want to talk with you about what to do if you’ve missed your court date.

First off I suggest that you contact an attorney. It is very important to do this as there are some circumstances where the court may not have already issued a warrant. If that is the case usually an attorney will be able to submit a notice of appearance on your behalf and a plea of not guilty. Your Attorney will be able to go in and take care of it right away.

However there are also some circumstances where the courts will issue warrants for your arrest. This makes it a little more complicated as some courts allow attorneys to file a motion to quash the warrant without you ever having to set foot in front of a judge. However there are also some courts who require that you be physically present before the judge and explain to the judge why you missed a court date. That is why it is very important to have an attorney represent you.

Finally there are some circumstances where a judge feels that your failure to appear is so egregious that he has actually issued a warrant and placed a bond on you. In these circumstances an attorney can assist you by having the judge issue or take back the bond and just allow you to be released on your own or recognizance.
