Description: Maricopa County Superior Court: State v. Mr. E.R. Mr. E.R. was charged with one count of Aggravated Assault, a Class 3 Dangerous Felony and one count of Criminal Damage, a Class 5 Felony. Mr. E.R. was accused of causing an accident while under the influence.  The accident resulted in permanent disfigurement to an occupant in the accident.  If convicted at trial, Mr. E.R. was facing mandatory prison time. After reviewing all of the police reports and submitting a deviation letter, the State agreed to allow E.R. to plead to an Endangerment, as an undesignated felony, with a DUI combination.  At sentencing, E.R. received eighteen months of probation, with thirty days jail.
