State v. Mr. D.A. (2020)

Outcome: Disorderly Conduct, a Class 1 Misdemeanor – Probation and no jail.

Description: Maricopa County, State v. Mr. D.A.  Mr. D.A. was accused of two counts of Aggravated Assault, Class 3 Felonies (one of which was domestic violence); Misconduct Involving Weapons, a Class 4 Felony; along with other charges.  If convicted at trial, Mr. D.A. was facing a permanent felony conviction and prison time. After a remand motion was filed back to the grand jury, and a plea modification was submitted detailing the inconsistencies in the 911 caller’s report along with other inconsistencies in the case, Mr. D.A. was offered a Plea Agreement to a single count of Disorderly Conduct as a misdemeanor, non domestic violence offense.  Mr. D.A. was sentenced to probation for one year with no jail time.
