What is a grand jury
Hi my name is Cindy Castillo with Castillo Law. I previously talked with you about the different ways that a case can get to felony court. One of those ways is in the event that a County Attorney has submitted your information to a Grand Jury.

I also discussed with you that is really important for you to contact an attorney in the event that you know your case is being presented to a grand jury. The reason for that, is that an attorney who is experienced with these areas can have some influence on a grand jury, in certain circumstances.

One of the first things that a defense attorney, who is experienced in the area, will look at is is there any information that you, the accused, can provide to a grand jury that might be able to persuade or convince the grand jury not to indict you on the charges. Now, this can be a very touchy area because if you come in and you present false information this is obviously a problem and you could be charged for providing false information to a grand jury. However, in certain circumstances where you believe that you are absolutely innocent of the charges this would be a situation where your attorney would take that information, provide the information to the prosecutor agency that’s going to be submitting to the grand jury, and if the prosecuting agency fails to present that evidence to the grand jury your case can be remanded back to the grand jury for a new finding. In many circumstances this is leverage for you in being able to negotiate your case.

Now another way that a attorney can help to influence the grand jury proceeding is by speaking with you in determining whether there is potentially any information that you can give to them that might lessen the charges that would be presented against you. There might be some sort of exculpatory evidence, that means evidence that is in favor of your innocence, and the attorney will present that in a nice letter on your behalf. Send it over to the prosecuting agency, that’s going to be presenting the information, and again if that prosecuting agency fails to present that to the grand jury then again your case can be remanded back for a new finding. It presents a nice way of being able to negotiate case.
