Hi my name is Cindy Castillo with Castillo Law. I often get asked the question: “Can I get a DUI on a bicycle?”

The answer the question is: No, you cannot be charged with a DUI if you are a bicycle or if you are on a horse.

What the state of Arizona requires is that you actually be on or in a vehicle. Now this could mean that you could get a DUI if you are on a four wheeler or some type of ATV. The important distinction is the horsepower. If it’s a certain horse power then you might be able to be charged with a DUI.
