New Year, New Future: Your 2026 Guide to Sealing Your Criminal Record in Arizona

The New Year is traditionally a time for resolutions: gym memberships, budget planning, or learning a new skill. But for thousands of Arizonans, the most important resolution isn’t about adding something new; it’s about clearing away the past and record sealing can help.

If an old arrest or conviction has been holding you back from the job you want or the home your family deserves, 2026 is the year to change that narrative.

At Castillo Law, we believe a past mistake shouldn’t be a life sentence. Thanks to A.R.S. § 13-911, Arizona now offers a powerful “Record Sealing” option that goes beyond the old “set aside” laws.

Here is everything you need to know about sealing your record this year, and how we can help you do it for free.

What Does “Record Sealing” Actually Mean?

For years, Arizona didn’t allow true expungement for most crimes. We only had “Set Asides,” which added a note to your record but didn’t hide it.

Record Sealing is different.

When a judge grants a petition to seal your record under A.R.S. § 13-911, the records of your arrest, conviction, and sentence are removed from public view.

  • Employers: In most cases, you can legally answer “No” when asked if you have been arrested or convicted of a crime.
  • Landlords: Background checks run by apartment complexes will generally come back clean regarding that offense.
  • Public Access: Your mugshot, arrest, and case details disappear from public court websites.

Am I Eligible for record sealing in 2026?

Eligibility depends on the severity of the offense and how much time has passed since you completed your sentence (excluding monetary conditions).

The Waiting Periods:

  • Class 2 & 3 Misdemeanors: 2 years
  • Class 1 Misdemeanors: 3 years
  • Class 4, 5, & 6 Felonies: 5 years
  • Class 2 & 3 Felonies: 10 years

Note: Serious violent offenses, crimes against children, and certain sex offenses are typically not eligible for sealing.

Why Do This Now? (The “New Year” Effect)

January is the busiest hiring month of the year. Companies are approving new budgets and opening new positions. If you start the process now, you take the first step toward walking into job interviews without the fear of the “background check” conversation looming over you.
