State v. Mr. A. R. (2021)

Practice Area: Criminal Law / Set Asides

Date: March 31, 2021

Outcome: Application to Set Aside Judgment—Granted

Description:  Gilbert Municipal Court: Mr. A. R. came to Castillo Law having previously accepted a Diversion Plea Agreement to Possession of Drug Paraphernalia, a class one (1) misdemeanor, where the State had filed a motion to impose sentence/resume prosecution due to Mr. A.R.’s failure to attend his treatment screening appointment.

Castillo Law was able to persuade the Judge to consider Mr. A. R.’s non-court ordered voluntary treatment as completing the required counseling terms of his plea agreement, so no additional sentencing requirements were ordered to be completed, and also persuaded the Judge to order the set aside of his conviction.
