State v. Mr. J.O. (2021)

Practice Area: Criminal Law / DUI

Date: March 9, 2021

Outcome: Reduced to Reckless Driving

Description: Downtown Justice Court, State v. Mr. J.O..: Mr. J.O. was pulled over by an unmarked white van for allegedly speeding. The Officer who pulled him over was aggressive towards him and his girlfriend. He had a BAC of .097.   Castillo Law was able to retain an expert to review the AVL data to attack the officer’s credibility by showing that the officer’s speed and pacing claims in his reports were inconsistent with the data. Based on this information, the prosecutor allowed Mr. J.O. to plead to a reduced charge of Reckless Driving. This prevented Mr. J.O. from having a DUI conviction on his record.
