Probationers must comply with all conditions of probation, including gang terms when specifically ordered. Not all probationers have the same terms or requirements while on probation, as these terms are negotiable and can be modified. If a probationer has violated the terms of probation, the probation officer can file a Petition to Revoke Probation and the probationer will have to return to court to see a judge. In some situations, the probation officer can obtain a warrant for the probationer’s arrest. Here are the fourteen items you need to know when your plea includes gang terms, before you sign your plea:
- You shall obtain and carry an Arizona Driver’s License or Arizona I.D. Card within 30 days of sentencing or your release from incarceration.
- You shall report contact with law enforcement to probation within 24 hours.
- You shall submit to search and seizure of person or property by any peace, law enforcement, or probation officer with or without a search warrant.
- You shall obtain prior written approval from probation before appearing at Court.
- You shall not enter any school grounds unless registered as a student there.
- You shall obtain prior written approval from probation before changing your place of residence and/or before residing with another individual not previously approved.
- You shall not display criminal street gang signs or gestures.
- You shall not wear or be found displaying, using, producing, or possessing criminal street gang related clothing or paraphernalia.
- You shall not possess criminal street gang related graffiti in any form or instruments used to apply graffiti including but not limited to: paints, aerosol spray cans, markers, and etching devices.
- You shall not threaten, intimidate, harass, or stalk anyone, including your probation officer and/or probation staff.
- You shall obtain prior written approval from probation before obtaining any tattoos.
- You shall abide by any curfew imposed by probation.
- You shall not associate with criminal street gang members or associates, or other individuals as identified by probation.
- You shall not enter any known criminal street gang gathering areas or other locations identified by probation.
