Description: Maricopa County Superior Court, State v. Mr. M.P. Mr. M.P. was charged with two counts of Theft of a Credit Card or Obtaining a Credit Card by Fraudulent Means, class five felonies, and two counts of Theft, class six felonies, after Mr. M.P. allegedly misused the work credit card given to him by his former employer. The initial plea offer made by the State was to have Mr. M.P. plead to Theft, a class six undesignated felony, with a stipulation to be placed on supervised probation for a period of up to three years and to a possibility of up to twelve months of jail as a term of probation. If Mr. M.P. had accepted this initial plea offer, he would have lost both his housing and employment.
Through negotiation and a plea modification request, Castillo Law was able to secure a diversion agreement with the State wherein Mr. M.P. was able to participate in a program and repay the damages to receive a full dismissal of the charges.
