Description: Maricopa County, State v. Mr. M. Mr. M. was charged with one count of Aggravated Assault, a Class 3 Dangerous Felony and one count of Misconduct Involving Weapons, a Class 4 Felony. Mr. M. was accused of discharging his weapon into a business where the bullet grazed the leg of an employee there. The State alleged a number of aggravating factors and if convicted at trial, Mr. M. was facing mandatory prison time. Mr. M. was placed into Rule 11 Court to determine his competency. The State thereafter challenged Mr. M.’s incompetency. At an evidentiary hearing, Ms. Castillo convinced the Court that Mr. M. was not competent to stand trial and that Mr. M. was not a threat to the community or his own safety. As a result, the charges against Mr. M. were dismissed.
