Outcome: REDUCED to one count of Sexual Abuse, a Class 5 Felony, with probation

Description: Coconino County, State v. Mr. S.  Mr. S. was charged with five counts of Sexual Abuse, Class 5 Felonies, one count of Kidnapping a Class 4 Felony, and one count of Assault, a Class 2 Misdemeanor. Mr. S. met the alleged victim at a bar and both parties, along with two friends, willingly went to Mr. S.’s home afterward. Mr. S. was accused of sexually abusing the victim while at the home. Mr. S. maintained that any contact was consensual. Mr. S. was facing substantial prison time if convicted at trial and the State’s offer was for Mr. S. to plead to five counts of Sexual Abuse. Ms. Castillo completed her investigation and provided mitigation and case weaknesses to the State in a deviation request. As a result, Mr. S. was offered a plea of one count of Sexual Abuse. He was sentenced to 3 years of probation, and deferred sex offender registration.
