State v. Mr. MH (2016)

Practice Area: Criminal Law/ OUI

Date: 11/17/2015

Description: Parker Justice Court: MH was alleged to have committed a first time regular OUI, after riding jet skis and being observed waking in a no-wake zone. If found guilty, MH would have been required to serve jail time, complete alcohol classes, and pay a fine. MH maintained his innocence throughout the pretrial litigation of his case, and Ms. Castillo argued that, due to the lack of reasonable suspicion for the OUI stop and lack of evidence, it was difficult to prove MH was guilty. Ms. Castillo secured a Negligent Boating plea offer. This prevented MH from having an OUI on his record.
