Not Guilty / Complete Acquittal / DUI Arizona – State v. Mr. S. (Scottsdale Municipal Case No. 2011-006843): Mr. S. and his wife were returning home from dinner. An Officer observed Mr. S.’s driving to be consistent with an impaired drivers. The Officer stopped Mr. S. and after the Officer observed signs and symptoms consistent with alcohol ingestion, Mr. S. participated in field sobriety tests. Mr. S. was then taken to the hospital where he submitted to a blood draw. Mr. S.’s BAC was a .098. Mr. S. was facing the minimum for a misdemeanor DUI. Mr. S. was also facing professional licensing board consequences for the charge. At trial, Ms. Castillo argued that Mr. S. was not impaired for driving by the alcohol he consumed and that the State’s contaminated blood draw over estimated the blood alcohol concentration result. The jury agreed with Ms. Castillo and acquitted Mr. S. on all charges.
