Description: Phoenix Municipal Court: CA was stopped for allegedly failing to maintain a lane after turning out of the parking lot of the Blue Martini Lounge in Phoenix. Officers claimed CA drove in the bike lane. CA performed field tests and was arrested. His blood was drawn and resulted in a .092 BAC. CA was charged with DUI. Mr. Goebel realized that CA was not given the ability to speak with an attorney at any point in time during the DUI investigation and arrest. Accordingly, Mr. Goebel filed a Motion to Dismiss for a violation of CA’s right to counsel. After an evidentiary hearing, the Judge agreed with Mr. Goebel’s motion and dismissed the case with prejudice.
