Description: (Maricopa County Superior Court CR2006-118277):  Officers received a tip from an unknown informant that Mr. GD. would be coming into the neighborhood in a specific car.  Officers waited for Mr. GD. to appear in the neighborhood and when they observed a traffic violation, Officers stopped Mr. GD.  Officers testified that Mr. GD. had an open container in his car and arrested him.  Upon searching the car, Officers alleged they found dangerous drugs and narcotic drugs inside the air vents in Mr. GD.’s car.  Thereafter, officers state they took Mr. GD. to his house to do a welfare check on his underage son.  After a number of interviews of witnesses in the neighborhood, at trial, Ms. Castillo presented testimony of two key witnesses.  One witness stated that officers were with Mr. GD. at the initial stop location for less than a minute and the second witness indicated that both her and her boyfriend had gone to Mr. GD.’s house, and that when officers arrived, she was detained.  The witness testified that officers entered Mr. GD.’s home, placed Mr. GD.’s son in handcuffs, and had taken items out of Mr. GD.’s home including a scale which the officers stated was found at the initial stop location.  Ms. Castillo was able to persuade the jury that the officers’ testimony was not credible.  The jury only found Mr. GD. guilty of possession and Mr. GD. was released from custody and placed on probation.  Mr. GD. was facing over 40 years in prison.
