Forks Up, Tailgates Down!

Tailgating season is upon us. Castillo Law has its own internal rivalry brewing between our ASU Sun Devil and U of A Wildcat alums, but no matter which team we support, we can all agree on one thing – we love college football! ASU football kicks off on Thursday, August 31, 2017, so grab your pals and get your grills, coolers and college swag ready!

Football and tailgating go together like…well, football and tailgating! While there are different theories about the origin of the tailgate as we know it, it’s been an American institution for over 100 years. Tailgating is a time-honored tradition in which fans gather to share their love of the game, enjoy good food, and hopefully some cooler temperatures! Unfortunately, it may also come with a rise in underage consumption, disorderly conduct, open container, public urination, and DUI citations. To lower your risk of receiving such a citation, Castillo Law recommends you drink responsibly, designate a driver, and review the rules and regulations imposed by your stadium and surrounding areas.

For all you Sun Devils out there, Castillo Law would like to give you a quick refresher on the policies ASU enacted in 2014 in order to combat underage and binge drinking. ASU is continuing their enforcement of their ban on kegs and other “apparatuses that encourage reckless consumption of alcoholic beverages.” You may see an increase in law enforcement officers walking the parking structures near the stadium keeping their eyes out for red solo cups, beer kegs, and beer bongs, which are commonly used for drinking games. The Sun Devil Stadium staff has previously emphasized “no red solo cups,” as they believe this will help officers to determine rule violations, including no hard liquor, no glass containers, no underage drinking, no seriously disruptive behavior and no contribution to the delinquency of a minor. Inside the stadium, a clear bag policy remains in effect. For more information, please visit www.thesundevils.com.

Sometimes a good time can get out of hand, and mistakes may happen. If you are contacted by law enforcement for any criminal or civil offense, you must provide your name and/or identification if an officer requests that information. It is imperative that you remain silent and ask to speak to an attorney before you make any admissions. If you find yourself facing any of these charges, it is important to contact a knowledgeable attorney. Castillo Law is available 24/7 to take your call at (602) 795-6701 or (480) 206-5204.

Have fun this season and support your team from the stadium – not the jailhouse! Go Devils!!!
