Practice Area: Criminal Law / Theft Crimes / Burglary and Theft by Extortion and Credit Card Theft

Date: December 16, 2014

Outcome: Probation

Description: Maricopa County Superior Court (CR2013-435078): SH was charged with one count of Burglary, one count of Theft by Extortion, and one count of Credit Card Theft by Fraudulent Means after the State alleged SH entered the victim’s house with the intent to commit a theft. Later the State alleged that SH attempted to prevent victim from calling authorities or further the theft by threatening to call the authorities against the victim. After arguing a motion hearing which was unsuccessful, but exposed weaknesses in the State’s case and days before trial, SH was offered a misdemeanor disorderly conduct with no jail time. SH was exposed to prison time after trial if unsuccessful as the State alleged that the offenses occurred on multiple dates.
