Ms. L. was stopped after officers received a 911 call for a reckless driver. Officers had Ms. L. perform field sobriety tests and arrested her after they say she performed poorly. Ms. L was taken for a breath test where officers alleged she was game playing with the breathalyzer. Ms. L.’s Brac was alleged to be a .128 and .120. Ms. L.’s case was set to trial. After three trials resulted in not enough jurors, a fourth trial resulted in a hung jury. At the retrial, there was an insufficient number of jurors and Ms. L.’s case was dismissed for a violation of her speedy trial rights.
