Hi! My name is Cindy Castillo with Castillo Law. Today, I’d like to talk to you about if you’ve been charged with a DUI, whether or not you might lose custody of your children.

In Arizona, there is a rebuttable presumption. If you are in the process of getting a divorce and part of that divorce includes a child custody battle and it’s within the year of being charged with that DUI, the rebuttable presumption is that you will lose custody of your children. However, you can rebut that presumption by showing the judge that either you are able to demonstrate successful test. That means clean test of a urine or breath samples. Or you might be able to show the judge that you were wrongly charged or wrongly convicted of a DUI.

But it’s important to remember that you should always contact both the family law attorney as well as a DUI attorney if you’ve been charged with a DUI and you are facing a child custody situation.
